1. Who this agreement is with
This agreement is between you, the customer identified in your written service confirmation, and Benjamin Miller, doing business as Miller’s Hometown Essentials (“we,” “us”). It covers residential bin-moving service at the single address we approve in Mount Washington or Duquesne Heights, Pittsburgh, Pennsylvania.
Your written service confirmation identifies your selected plan, approved bins and locations, collection schedule, first service date, billing date, total price including any applicable tax, and any agreed exceptions. That confirmation and this dated agreement form your service agreement. A specific written exception agreed by both parties controls over a conflicting general term, but cannot waive rights the law protects.
2. Owner approval & acceptance
An inquiry is not an enrollment, a reservation, a purchase or permission to charge you. We first review your address, route capacity and access. We may decline a request before enrollment.
After we have agreed on all service details, we send your written service confirmation and a private Stripe-hosted payment link for your approved customer profile and plan. On that page, review the linked agreement, check the required agreement box, review the monthly payment authorization, and submit your payment. Stripe records your acceptance with the Checkout Session; we retain the agreement version and service confirmation with that record. No separate acceptance email reply is required. Merely visiting this page, submitting an inquiry or remaining silent does not constitute acceptance. Do not share your private enrollment link.
You must be at least 18 and authorized to arrange service and grant access at the property. A payer who is different from the customer must separately authorize use of their payment method. We approve your service and agree on all details, including your first visit, before sending your payment link. Accepting this agreement and making a successful initial payment starts your monthly subscription; no further approval, signature or confirmation is required from you. Your first visit takes place on the date already agreed. A payment that is still processing or has failed does not count as a successful payment.
3. What the plans include
- Trash-to-Curb — $40 per month: one scheduled outward visit per weekly collection cycle, moving the approved residential bins from their agreed outdoor storage location to the agreed lawful collection point. You arrange their return.
- Trash-to-Curb & Return — $60 per month: the same outward visit plus one return visit after collection, bringing the approved bins to their agreed outdoor storage location.
Monthly prices cover the scheduled weekly cycles falling within your paid billing period, including months with five collection cycles. This is a bin-moving service, not trash hauling, disposal or a guarantee that a hauler will collect your waste. Both plans include up to three approved trash and/or recycling containers total per scheduled collection cycle—not three trash bins plus three recycling bins. For the return plan, the same approved containers are moved out and returned; the return visit does not create an additional allowance. The service confirmation specifies bin number, type, collection days, recycling inclusion and any approved stairs or other access conditions. Recycling is included only when approved for the same scheduled collection-day service. Additional containers, separate collection-day visits and extra trips require approval and may cost extra; any additional price must be agreed before service or charging. Containers must meet the hauler’s requirements and be safely movable by one person. We assess stairs, slopes, carrying distance and bin condition before approving the property; the three-container allowance does not override safe-access requirements.
We do not enter living spaces or locked buildings, use ladders, sort or bag waste, clean bins, shovel or de-ice access paths, haul loose garbage, or move bulk items, furniture, appliances, construction debris or hazardous materials under these plans. Lawn care, window cleaning, snow services and merchandise shown as coming soon are not included or available under this agreement; they require separate terms and approval if offered later.
4. Collection schedule & lawful placement
You provide an accurate hauler schedule, approved collection point, holiday changes and any property or association restrictions. Tell us promptly when those details change. We confirm an achievable service window before accepting the address; exact arrival times are not guaranteed.
For City of Pittsburgh collection, bins are set out no earlier than 6 p.m. the evening before collection and by 6 a.m. on collection day. Return-plan bins are returned after collection and by 10 p.m. on collection day. The return visit is normally the day after the outward visit, not the day after collection. To-curb-only customers are responsible for arranging timely return. If applicable rules change, we follow the lawful window and tell you about any resulting service change.
We do not block sidewalks, curb ramps, driveways, hydrants or traffic. If collection is delayed or missed by the hauler, we contact you to agree on a lawful next step. Extra trips are not automatic. Do not assume bins can remain at the curb beyond the permitted window. We do not guarantee against citations or hauler actions, but this does not excuse violations or damage caused by our own conduct.
5. Safe bins, clear access & property permission
You authorize us and any personnel we assign to use only the agreed outdoor route to move the approved bins during the agreed service window. You are responsible for obtaining permission from an owner, landlord or association when needed. Tell us about gates, steps, steep slopes, fragile surfaces, loose rails and other hazards before service.
Keep bins identifiable, in the agreed location, reasonably clean externally and safely movable by one person. Lids, wheels and handles must be secure. Bins and contents must comply with the hauler’s size, weight and preparation rules. We may refuse bins that are overloaded, leaking, broken, frozen in place, contaminated, hazardous or unsafe to handle. Never put exposed sharps or hazardous waste where we must handle them.
Keep the route clear, adequately lit, unlocked and free of ice, snow, debris, vehicles and other obstructions. Secure animals away from the entire route. We do not force gates, climb fences or move obstacles. Tell us about access changes before the visit. Do not submit keys, alarm codes or gate codes through the public inquiry form; any necessary access arrangement must be agreed privately.
6. Missed visits, weather & service remedies
We may postpone or stop work when conditions present a reasonable safety risk, including severe weather, lightning, ice, flooding, dangerous paths, aggressive animals or unsafe bins. We notify you as soon as reasonably practicable and explain whether a safe, useful make-up visit is possible. An emergency or unsafe condition never requires either party to risk injury.
If we arrive but cannot perform because bins are absent, access is blocked or a customer-controlled hazard prevents service, that attempted visit counts as a scheduled visit and is ordinarily not refunded. A return trip requires a separately agreed arrangement. Tell us in advance about vacations or desired pauses; a pause is effective only when we confirm its dates and billing treatment.
If we miss a visit for reasons within our control, we offer a timely make-up visit where it still meets the service purpose; otherwise we credit or refund that visit. The same credit or refund applies when unsafe weather or another outside event prevents a visit and no useful make-up is provided, except for the customer-controlled conditions above. The visit value is the monthly service charge divided by the number of scheduled visits in that billing period. We refund the value instead of leaving a credit if the account closes. These remedies do not limit other remedies required by law or claims for damage caused by our negligence.
7. Monthly renewal & payment authorization
Your selected $40 or $60 plan renews automatically every month until canceled. Any legally applicable tax and the total recurring charge are disclosed in your service confirmation before you authorize payment. There is no annual commitment, setup fee or automatic extra-service charge under these plans.
Your successful initial payment starts your subscription and first monthly billing period. Your first service visit takes place on the date agreed before payment. Your saved payment method is charged automatically each month on your individual billing schedule until canceled; billing is not automatically moved to the first of the month. When a month lacks your billing day, billing falls on its last day and follows Stripe’s calendar-month schedule thereafter. There is no additional approval or activation step after successful payment.
You authorize Miller’s Hometown Essentials, through Stripe, to securely save your chosen reusable payment method and charge the disclosed recurring amount monthly, along with separately authorized adjustments, until you cancel or revoke authorization. Stripe hosts payment entry; never email or text card or bank details to us. Complete any payment-method-specific mandate or verification Stripe requires. We provide a copy of your authorization and service confirmation by email. You may request a paper copy or an alternative arrangement before agreeing to electronic records.
Stripe creates the subscription and initial invoice through enrollment, saves the payment method for the subscription, and automatically generates and collects future monthly invoices. You do not need to pay a separate first invoice after completing Checkout. Payment and acceptance checks are handled by us behind the scenes and do not create another customer approval step. A processing or failed payment must finish successfully before your subscription begins. Keep your contact and payment information current. We send payment receipts and applicable billing notices through Stripe; delivery failures do not create permission for new charges or remove your cancellation rights.
8. Cancel, revoke authorization or change your plan
Cancel at any time by emailing miller.benjamin0727@gmail.com or replying to your service-confirmation email. Include your name and service address so we can identify the account. No special form, phone call, fee or explanation is required. We also honor any other valid cancellation notice we actually receive.
A cancellation received before the next renewal stops that renewal. We acknowledge it promptly and confirm the last service date. Processing delay on our side does not extend your subscription: if a renewal charge occurs after your timely cancellation, we refund it. You do not have to wait for our acknowledgment to make your notice effective.
Unless you ask us to stop sooner, scheduled service continues through the paid period. Ordinary mid-period cancellation does not automatically refund a partially used month, except for the refunds, credits and legal rights described here. If you cancel before any service begins, we refund your initial payment. Revoking recurring-payment authorization stops future automatic charges; it does not erase an amount already legitimately owed. Any remaining balance is handled separately, without new automatic charges after revocation.
Plan changes, moves and pauses require our written confirmation. We disclose any proration, changed renewal date or additional charge and obtain your approval before applying it. There is no automatic transfer of service to another address.
9. Failed payments & suspension
Stripe may retry a failed authorized payment and send a secure payment-update or authentication link. We may suspend service after notifying you of nonpayment, and cancel if it remains unresolved. We do not charge a late fee under this agreement or continue creating charges for new periods after cancellation.
Before resuming service, we confirm payment, availability and any revised dates. We credit or adjust charges for visits we did not provide during a payment-related suspension so that payment recovery does not charge you for unprovided visits. Cancellation does not automatically void a valid balance for services already supplied. You may dispute errors directly with us, your payment provider or a regulator; contacting us first is helpful but is not a condition of your legal rights.
10. Price changes & ending service
We give at least 30 days’ notice before a price increase or material change to recurring service terms. We obtain your affirmative agreement before charging an increased recurring price. If you do not agree, we can end service at the end of the paid period with notice; we do not treat silence as consent to the increase. A website update does not retroactively replace the agreement you accepted.
We may end service for unsafe conditions, persistent access problems, nonpayment, abusive conduct, loss of route capacity or discontinuation of the service. We give reasonable notice when practicable and may stop immediately for safety. If we end service before the paid period finishes, we refund unused prepaid service, less only valid charges for visits already supplied or customer-caused attempted visits described above. We do not retain payment for future service we choose not to provide.
11. Property care & responsibility
We use reasonable care when moving bins. You are responsible for maintaining your bins and property and disclosing known hazards. We are not responsible for pre-existing damage, ordinary wear from proper use, hidden defects, or loss caused solely by the hauler, third parties, animals or weather when our conduct did not contribute to the loss.
Tell us promptly about any incident and, where reasonably possible, retain photos and the affected item so the cause can be assessed. A request for prompt reporting is not a shortened legal claim deadline.
This agreement does not release us from responsibility for our negligence, gross negligence, reckless or intentional misconduct, or liability that cannot lawfully be excluded. Neither party is made responsible for the other’s wrongdoing merely by entering this agreement. We do not promise that bins are protected against theft, wind or animal interference, or that a hauler will collect prohibited or improperly prepared waste. Responsibility for a fine or loss depends on its cause and applicable law.
12. Privacy & service communications
We use inquiry and customer information—such as your name, address, phone, email, selected service, access instructions and billing records—to assess coverage, communicate, perform service, collect authorized payments and address questions or disputes. The inquiry form uses FormSubmit to deliver your request; email services handle correspondence; Stripe processes payments and billing. Hosting and font providers may receive technical connection information when the site loads.
We share information with service providers and assigned personnel only as needed for their role, and when reasonably necessary for legal obligations, safety or a dispute. We do not sell customer information or use property photos in advertising without separate permission. We may document bin placement, access conditions or an incident with limited service-related photos; we avoid photographing people or interiors unnecessarily.
We retain records as reasonably needed for service, accounting, consent evidence, legal obligations and dispute handling, then delete or de-identify them when no longer needed. Email us to request access, correction or deletion; lawful retention requirements may limit deletion. Do not submit sensitive payment information or access codes in a public form.
Providing contact details permits relevant responses and service/billing notices, not unrelated marketing consent. You can ask to change how we contact you. Any optional marketing consent is separate and is not required to receive service. Stripe’s handling of payment data is also described in its privacy policy.
13. Consumer rights & disputes
Pennsylvania law governs to the extent permitted by applicable law. Nothing here waives statutory cancellation, refund, consumer-protection or payment-dispute rights. If a sale qualifies for a statutory cooling-off period, including certain in-person or telephone residential sales, those rights control over ordinary cancellation terms, and we provide the required individualized notices and seller contact information privately. This general webpage is not a substitute for those notices.
Please contact Benjamin at miller.benjamin0727@gmail.com so we can try to resolve concerns. No mandatory arbitration, class-action waiver, confidentiality restriction or restriction on truthful reviews is imposed by this agreement. Either party may use a court with proper jurisdiction, including small-claims procedures when available; no unlawful restriction on venue or legal remedies applies.
If a provision is unenforceable, the remainder continues to the extent legally permitted. A failure to enforce a provision once is not a permanent waiver. These terms do not substitute for any permits, insurance, required notices or legal obligations that apply to the business.
14. How approved customers accept
After Benjamin approves your address and capacity, you receive a personalized service confirmation and one private Stripe-hosted enrollment link. The confirmation identifies your address, plan, approved bins, collection and access arrangements, and first scheduled visit. The payment page shows the recurring amount and links to this dated agreement.
- Review your service confirmation and the linked agreement before paying. Ask Benjamin to correct anything inaccurate.
- Check the required agreement checkbox. It confirms acceptance of this agreement and your approved service confirmation, your authority to arrange service and outdoor access, and the stated monthly recurring-payment authorization.
- Enter your payment details securely on Stripe and select Subscribe to authorize the initial payment and monthly automatic renewal until canceled. Complete any payment-method verification shown.
The checkbox is not preselected, and enrollment cannot be completed without it. Stripe records acceptance with the Checkout Session. We retain the accepted version and confirmation and provide a copy for your records. A separate email reply accepting the terms is not required. Your successful payment completes enrollment and starts your monthly subscription. Your first visit follows the schedule already agreed; no further customer approval or confirmation is needed. A payment still processing has not yet completed enrollment.
Each enrollment link is issued for an approved customer and plan, allows one completed enrollment, and expires if unused. If it expires, contact Benjamin for a replacement. Do not forward it: possession of a link is not approval of a different person or address. No enrollment or payment link is published on this website.
